In order to reimburse him for the hush money Trump had asked Cohen to pay adult film actress Stormy Daniels in the weeks leading up to the 2016 election in order to prevent her from speaking out about an alleged affair she claims she had with Trump, Michael Cohen, Trump’s personal attorney at the beginning of his presidency, claimed that Weisselberg had arranged for the Trump Organization to pay Cohen $35,000 per month.

Weisselberg was summoned to appear before a federal grand jury to provide testimony about the Cohen probe in July 2018.  For his testimony, Weisselberg received a limited level of witness immunity. Cyrus Vance Jr., the district attorney for New York County, was also looking into Weisselberg. Vance filed more subpoenas in relation to the hush-money payments after the federal investigation by the U.S. District Court for the Southern District of New York “essentially finished” in July 2019. The federal immunity granted to Weisselberg does not cover state inquiries.

In February 2021, after the US Supreme Court gave Trump’s accountants permission to provide him access to Trump’s personal and company tax data, Vance intensified his state criminal probe. The investigation was allegedly then concentrated by Vance’s staff on Weisselberg, along with Donald Trump Jr. and Eric Trump, with the intention of getting Weisselberg to “flip” and testify against his boss. According to the New York Times, investigators also reportedly questioned a witness regarding Weisselberg’s sons, Barry, who oversaw Wollman Rink, and Jack, who works for Trump Organization lender Ladder Capital. Prosecutors were looking at Weisselberg and his family members’ financial records by March 2021. Jen Weisselberg, his ex-daughter-in-law, who was wed to Barry Weisselberg from 2004 until 2018, turned up to the Manhattan District Attorney a number of documents that showed how some Trump staffers were paid in real estate and other things.

In May 2021, CNN reported that Weisselberg had been the subject of a criminal tax investigation that had been started months earlier by the New York State Attorney General.
